A principle in legal procedure that establishes the separation of the court's adjudicatory function from the prosecution or defence functions, i.e. the court directs the trial inquiry process and decides the question submitted for adjudication, but the court may not seek new evidence or refer in its judgment to facts not put before it by the parties to the proceedings; the court may decide only the question submitted to it.

Princips tiesvedībā, kas nosaka tiesas spriešanas funkcijas atdalīšanu no apsūdzības vai aizstāvības funkcijām t. i., tiesa vada tiesas izmeklēšanas procesu un izlemj iztiesāšanai nodoto jautājumu, taču tiesa nedrīkst meklēt jaunus pierādījumus vai spriedumā atsaukties uz faktiem, ko tiesas priekšā nav likušas procesa puses, tiesa drīkst izlemt tikai tai nodoto jautājumu.
